Who actually qualifies for IFICI

Three conditions on you, one on your job. Almost everyone who fails IFICI fails on the job, not on themselves.

The shape of the test

IFICI asks two separate questions. Whether you personally are admissible, which is a short list of conditions about your tax history. And whether the work you will do in Portugal sits in one of the eligible categories, which is decided by your employer and your role, not by you. The second question is where applications fail.

Admissible, eligible, and still eligible next year

Advisers tend to answer the first question and stop. The tax authority checks all three, and the third one is the reason people lose the benefit in year four.

The person test

Your tax history, and nothing else.

You must become a Portuguese tax resident in the year you want IFICI to start, must not have been resident here for tax purposes in the five years immediately before, and must never have used the non habitual resident regime, Programa Regressar or IFICI itself. Nationality, age and salary are irrelevant.

The activity test

The employer qualifies, not the person.

Your work has to fall in one of the categories set by Ordinance 352/2024/1, and each category is signed off by a different authority. Whether you qualify usually turns on facts about the company: whether it holds an investment contract, whether it exports at least half its turnover, whether it is a certified startup.

The annual test

You have to keep earning from it.

Eligible income has to arrive every year of the window. A year without it is a year not enjoyed, and you can resume in any remaining year. Better still, if you start a new eligible activity within six months of ending the previous one, the tax authority treats it as no break at all.

The categories, and who signs each one off

Ordinance 352/2024/1 routes each category to its own certifying body. You apply to the tax authority, but the underlying confirmation comes from whichever entity owns your category.

Teaching and scientific research
Higher education teaching and scientific research, including scientific employment in entities of the national science and technology system, and posts and board seats in certified technology centres. Certified by the Fundação para a Ciência e a Tecnologia
Qualified posts under a productive investment contract
Qualified positions and board seats in entities benefiting from the productive investment tax regime. Certified by AICEP
Highly qualified professions, investment benefit companies
An Annex I profession in a company with relevant investment applications. Recognised by the tax authority itself
Highly qualified professions, exporting companies
An Annex I profession in an industrial or service company that exports at least 50% of its turnover, measured in the year you take up the role or in either of the two years before it. Intra EU sales count. Recognised by the tax authority
Qualified posts in entities of national economic relevance
Qualified positions and board seats in entities recognised as economically relevant. Certified by AICEP or IAPMEI
R&D staff under SIFIDE

“Highly qualified” is a defined term, and it only binds two categories

The degree requirement people worry about applies to the two categories the tax authority recognises directly. There you need an Annex I profession, meaning senior management, engineering and physical sciences, medicine, university teaching, ICT or industrial design, plus a qualification at level 8 of the European Qualifications Framework, or level 6 with three years of documented professional experience. The other categories, the startup route included, carry no qualification minimum at all.

The ones we answer on almost every call, and the ones the market most often gets wrong.

Do I qualify because of my salary or my job title?

Neither on its own. Eligibility runs through the activity and the entity. A large salary in a company that fits none of the categories qualifies for nothing, and a modest board fee in a certified startup can qualify.

I held NHR years ago. Can I move to IFICI?

No. Having previously benefited from the non habitual resident regime rules you out, as does Programa Regressar, and so does having already used IFICI. This is a one regime per lifetime rule, not a queue.

My profession is not on the Annex I list. Is that the end of it?

Not necessarily. Annex I only matters for the two categories the tax authority recognises directly. If your employer holds a productive investment contract, is recognised as economically relevant, runs SIFIDE eligible R&D, or is a certified startup, the route is the entity rather than your profession.

What counts as not having been resident for five years?

Tax residence, not physical presence or property. The test is the five years immediately before the year you become a Portuguese tax resident, and residence for tax purposes is decided under Article 16 of the personal income tax code.

What happens if I change jobs?

Nothing, provided the new role is also in an eligible category and starts within six months of the old one ending. The tax authority’s own example has a teaching role ending in June 2026 and a startup role starting that September: the benefit continues, the ten year clock does not restart, and a fresh registration is due by 15 January of the following year.
